Open Question: I received a Notice of Termination, without any warning, because my young kids are noisy?
My landlord served me a notice of termination today for “disturbing the peace of others.” She explained that the kids were just too noisy for the old woman living below me. She never even gave me any warning. I did know that I was a bother to the woman because she once sent her son up to beat on my door and yell at me, in which I kindly apologized and offered that I was doing the best that I could (though I should have sent him on his way as rudely as he came).
My children are very well behaved, they spend a lot of time at the table doing crafts, and I’m very proud that they do not jump off the furniture, they have broken the habit of jumping around since we moved in, and they hardly ever run in the house (no, they are not perfect and they do occasionally forget, but I’m on them all the time and stop it quickly.)
I know everything sounds loud around here, her sliding door sounds like thunder when she goes out to smoke, her smoke comes in my windows, and the neighbors beside me sound like they are remodeling when they are actually just putting away their dishes. I’ve lived below before and I know a quiet couple can sound like a rodeo through the floor.
Can I really be terminated for the sound of my family living up here? Shouldn’t I get a warning first? can I fight it? I can’t afford to break my one year lease to leave, but they can so quickly terminate it and evict me for my children making normal sounds for children? What do I do?
Also, I dealt with the inconvenience of her smoking below my patio. I quit smoking almost a year ago and the smell makes it difficult for me, plus it is stinky and bad for our health. I never said or did anything because I wanted to respect what I believed was her right to live her lifestyle on her premises, and was willing to inconvenience myself to give her that respect. Now I want to demand that she not smoke on her patio as it is “disturbing my peaceful enjoyment.” Should I? Hers is even illegal in oregon now, to smoke close to my door like that.
Open Question: Is there any way I can help my friend?
Well we are both 14. We were best friends in K-4th grade i guess, and then we sort of went our different ways. Well, we are starting to talk again, and I’m worried about her. She is telling me about the times she goes to the hooka bar (huka? im not sure). And about all of the times she has had sex, with many, many different guys. All of her boyfriends are 17, 18 years old. She said she has quit smoking, but she drinks.
Now, here I am, I go to a private Christian school, I guess compared to her, I am a goody goody, but I’m okay with that. I dont want to lose my virginity at 13! anyway, im not worried about her influencing me, but I want to help her if there is a way. Do you amazing people of yahoo! answers have any suggestions?

Open Question: How do I legally Kick my sister out of my Mothers apartment. She is not on the lease & does not pay rent.?
She has been staying there on and off for years. She moved in this time in November is right now staying at a friends house for the past 2 weeks because her doc said it is too stressful for both of them to live together. I asked her if she was going to move out, and she just laughed and said “why would I do that?” She has stolen from our Mom, and she smokes in my Moms apt after my Mom quit smoking due to medical issues. My sis takes advantage of my Mom making her feel guilty for things that happened when we were children and uses it against her to get more money etc from her. My Mom is very poor and way too nice. She doesn’t want to kick her out because it her daughter but we all know it would be best for the whole family. My Mom has even said she would be happier if she didn’t live with my Sis but my Mom thinks my sis will hold this against her and never see her again, My sister is 30 years old, doesn’t work, and makes false medical claims. She has diabetes and doesn’t take care of it because she knows it bothers my Mom, and claims it costs too much money to take care of it. She is about to get on SSD. It is very frustrating for me because My Mother and I are close and I hate seeing anyone take advantage of her.
sounds like Mom will cooperate now. She agrees that she doesn’t want her living there anymore. She is wondering if she is required by law to give her a 30 day eviction notice. My sis says she doesn’t want to live there anymore anyways, and isn’t living there now. All that is there is her stuff.
